LIMITATION OF LIABILITY 4.1. In no event will Amust or its suppliers be liable to you for any consequential, incidental or special damages, including any lost profits or lost savings, even if an Amust has been advised of the possibility of such damages, or for any claim by any third party. Some states or jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, so the above limitations may not apply to you. 4.2. The entire liability of Amust and any of its suppliers under any provision of this EULA and your exclusive remedy for any damage shall be limited to the amount actually paid by you for the software product. 4.3. The foregoing limitations, exclusions and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose. 5. GOVERNING LAW AND GENERAL PROVISIONS 5.1. This Agreement will be governed by the laws in force in the State of Delaware, USA, excluding the application of its conflicts of law rules. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. 5.2. If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. 5.3. This EULA (including any addendum or amendment to this EULA which is included with the software product) is the entire agreement between you and Amust relating to the software product and the support services (if any) and they supersede all prior or contemporaneous oral or written communications, proposals and representations with respect to the software product or any other subject matter covered by this EULA. 5.4. This Agreement shall automatically terminate upon failure by you to comply with its terms.
